Your privacy is important to us and we at Fullpower Technologies, Inc. (“Fullpower”, “We”, “Us” or “Our”) have prepared this Privacy Policy to explain to you how we collect, use, and share information we obtain through your use of,, and any software application that references this Privacy Policy in the end-user license agreement for that application (collectively, the "Sites"). This Privacy Policy does not govern our use of any information you provide to us when you call us, write to us, or communicate with us in any manner other than through the Sites. Because the Internet is global, information about you that we collect or that you submit may be transferred to, processed in, and held in countries (including the United States) other than the one in which you reside. By using the Sites, you explicitly consent to such use of your information and agree to the terms of this Privacy Policy. This Privacy Policy is effective as of August 13th, 2016.

EU – U.S. Privacy Shield

Fullpower participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework.  Fullpower is committed to subjecting all personal data received from European Union (EU) member countries, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles.  To learn more about the Privacy Shield Framework, visit the U.S. Department of Commerce’s Privacy Shield List.

Fullpower is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf.  Fullpower complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Fullpower is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Fullpower may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

1. Collection and Use of Anonymous Information. We automatically collect certain anonymous information to help us understand how you use the Sites. For example, each time you visit the Sites we may automatically collect your IP address, browser and computer type, access time, the Web page from which you came, Internet service provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, clickstream data to analyze trends in the aggregate administer the site and the Web page(s) that you access during your visit to analyze trends in the aggregate administer the site. Fullpower use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Third parties who place advertisements on the Sites may also collect anonymous information through cookies to ensure that their advertising systems and technologies work properly and to allow them to track responses to their advertisements. We also may use third parties to monitor how the Sites are used and such third parties may use cookies or similar technologies to compile anonymous statistics on visitors to the Sites on our behalf. When you download and use our mobile applications, we automatically collect information on the type of device you use, system and performance information and operating system version.

We send you push notifications from time-to-time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information.

We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application.

2. Collection and Use of Personal Information. You can visit the Sites without telling us who you are or revealing any information by which someone could personally identify you (which we will refer to in this Privacy Policy collectively as "Personal Information"). If, however, you wish to register to become a member of the Sites, to receive or participate in certain products, services or activities (such as contests) that we offer through the Sites, or to receive communications from us about the Sites, you may be required to provide certain Personal Information (e.g., your first and last name, e-mail address, birthdate and health information (such as sleep records, activity goal and sleep goal) that are tied up with your personal information) and we may ask that you also provide a user name and password. We use your Personal Information to fulfill your requests for products and services, to improve our services, to contact you from time to time about us, our Sites, and our products and services, to provide and support marketing and promotional activities on the Sites, and as otherwise specified when your Personal Information is collected. Fullpower may also collect your general geolocation in order to provide our services. We do not collect precise geolocation data and you may revoke previously granted permission at the device level. While using our MotionX and Sleeptracker application, the application may request access to your Bluetooth, camera accessories and photos/media/files.

3. We may share your information with third-party business partners, for instance, for the purpose of enhancing our products and services or so that they can market their products or services to you. If you do not want us to share your personal information with these companies, contact us at

(a) Service Providers. From time to time, we may enter into relationships with third parties who provide services to us (e.g., data management and storage services, credit card processing services, or shipping services). In those circumstances, we disclose Personal Information that is necessary for such service providers to perform those services. These companies are authorized to use your personal information only as necessary to provide these services to us.

(b) Business Partners and Affiliated Companies. We may share your Personal Information with: our corporate affiliates and joint ventures; other companies with whom we have business relationships (for example, companies who sell devices that are designed to work with applications developed by Fullpower); and those companies’ affiliates. In each of these circumstances, we may share your Personal Information for the purposes of maintaining the functionality of the Sites and devices; to better understand, personalize, and improve user experience; for customer support; to notify you of and address technical issues with the Sites or devices; to market relevant products or services to you; and when you otherwise approve or request us to do so. This Personal Information may include: your contact information (such as your personal name, account name, and email address); information relating to your account or registration; information you have entered or that has been collected by your device (such as gender, height, weight, steps, and sleep); information relating to your device (such as device model and serial number); information relating to customer support requests (such as contact information and support ticket identifications); and other information that may be useful to such companies to understand your use of the device and the Sites. This information may be transmitted electronically (including via the Internet) or physically. Those companies may use your Personal Information in accordance with those companies’ own privacy policies. (c) Other Disclosure Scenarios. In certain situations, Fullpower may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements (1) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims; (2) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person or property; (3) if we believe it is necessary to investigate, prevent, or take action regarding significant abuse of the infrastructure of the Sites or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of information); (4) we may also disclose your personal information to any other third party with your prior consent and (5) if we are acquired by or merged with another entity. You will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your personal information, and choices you may have regarding your personal information.

4. Public Areas. There may be areas of the Sites (e.g., message boards, discussion rooms, and other online forums) in which you are able to post information that will be available to all other users of the Sites. By choosing to use these areas, you understand and agree that anyone may access, use, and disclose any information (including personal information) that you post to those areas. In addition, if the Sites enable you to create a profile and to include information about yourself in your profile and you send a message through the Sites to another user or post any materials using the Sites to any social networking site, we may disclose to the recipient or on such social networking site your user name and the photos (if any) that you have added to your profile. If you would like to modify any Personal Information you previously have submitted to us in connection with creating an account on the Sites, please do so by logging into your account and updating your profile. We will respond to these requests within a reasonable timeframe.

We will not be responsible for modifying or removing Personal Information from the database of any third party to whom we were authorized to disclose your Personal Information prior to processing your request. Please note that any User Information that we have copied may remain in back-up storage for some period of time after your request. We will retain your information for as long as your account is active or as needed to provide you services. We follow generally accepted standards to safeguard your Personal Information against loss, theft, and misuse, as well as unauthorized access or disclosure, both during transmission and once it is received. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, we cannot guarantee its security and you assume all risk that any information you provide to us may be disclosed to or intercepted by unauthorized third parties. 8. Children's Privacy. We are committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The Sites are not intended for and may not be used by children under the age of 14. We do not knowingly collect Personal Information from children under the age of 14. If we learn that we have collected Personal Information from or about a child under the age of 14, we will delete that data from our systems.

9. Changes. We may update this Privacy Policy from time to time. If under any such update we make any material change to the way in which we treat your Personal Information, we (a) will inform you of such change via email or by posting a notice on relevant areas of the Sites and (b) will not use your Personal Information in the way contemplated by such updated Privacy Policy unless you have given us your consent to do so.
